Terms and conditions of sale and use

Last updated: 26 October 2026
These terms apply to the use of OmniStay, published by LS FORMATION FZCO, a free zone company established in Dubai, United Arab Emirates (hereinafter “OmniStay”), by any business that creates an account (hereinafter “the client”). OmniStay is reserved for professionals: by creating an account, you declare that you are acting for the purposes of your business.
1. The service
OmniStay is online software for managing short-term rentals and property management: calendar and synchronisation with booking platforms, messages to guests, organisation of cleaning and key handover, owner portal, guest guide, statistics and walkthroughs. Features evolve regularly; an essential feature is not withdrawn without notifying the client one month in advance.
2. Account and access
The account opens with the subscription: when creating their account, the client chooses their number of listings, their plan and their term (monthly, annual or 2-year), registers their card and pays for the first period online, or, with a free month, at the end of that month (article 4). A free demo, with no account needed, makes it possible to try OmniStay first. The client provides accurate information and keeps their login details confidential. They can give access to their team and their owners; they remain responsible for how it is used and remove access that is no longer needed.
3. Prices
- OmniStay: €9.90 per listing per month on the monthly term (cheaper on the annual and 2-year terms, below), for the number of listings chosen by the client, which they can change at any time from their account. A listing connected by OmniStay to a booking platform beyond that number is added to the subscription, pro rata; before it is connected, a message shows the client the new amount of their subscription.
- Terms: on the monthly term, €9.90 per listing per month; on the annual term, €7.90 per listing per month, i.e. €94.80 a year; on the 2-year term, €7.40 per listing per month, i.e. €177.60 for two years. On the annual and 2-year terms, the subscription is paid in advance for the whole period, and the monthly price of add-ons taken à la carte is reduced by 20% or 25% respectively, rounded to the nearest euro.
- Plans: the price per listing is the same in every plan, and each plan adds a set of add-ons to the price of the listings: Essential (the price of the listings only, with no add-on included); Growth (Showcase website and Social media add-ons included: €29 a month on the monthly term, €23 on the annual term, €22 on the 2-year term); Autopilot (Showcase website, Social media, WhatsApp and SMS, and AI assistant add-ons included: €59 a month on the monthly term, €47 on the annual term, €44 on the 2-year term); All Inclusive (Showcase website, Social media, WhatsApp and SMS, AI assistant, and Payments add-ons included: €99 a month on the monthly term, €79 on the annual term, €74 on the 2-year term). Where a plan includes the AI assistant, it is included at the first amount (€20 a month); a higher amount is paid in addition, for the difference between the two à la carte prices. Any other add-on is taken à la carte, at any time, at the price below.
- Currencies: euro, dollar, pound sterling, with the same figures (€9.90, $9.90 or £9.90 per listing per month). The currency chosen when subscribing remains the currency of the subscription.
- AI assistant add-on: from €20 a month, depending on the amount chosen by the client (€20, €40, €60, €80, €100, €150, €200 or €400 a month), which they can change at any time from their account. The assistant usage included each month follows this amount.
- Showcase website add-on: €19 a month.
- Payments add-on: €49 a month, with no commission on guest payments.
- WhatsApp and SMS add-on: €15 a month, number included. SMS messages are prepaid, through SMS credit topped up in packs of €10, €25 or €50 charged at purchase (€0.18 per 160-character SMS to France; the price for each country is given in the app).
- Social media add-on: €19 a month, in beta. The AI assistant is not included: it remains a separate add-on.
No VAT is charged: OmniStay is sold by a company established outside the European Union to professionals, who declare the VAT due in their own country themselves (reverse charge, article 196 of Directive 2006/112/EC). Every invoice states this. The team app, the owner portal and the walkthroughs are included, with no limit on people. OmniStay may change its prices by notifying the client at least one month in advance; the client may then cancel at no cost. These changes do not apply to the founder rate described below.
Founder rate (launch offer, terms of 26 October 2026): a client who subscribes with the launch offer “LANCEMENT”, reserved for the first 100 subscriptions until 30 November 2026, keeps that subscription’s per-listing price (€9.90 per listing per month on monthly billing, €7.90 on annual billing, €7.40 on 2-year billing, or the same amounts in their currency) for as long as that subscription remains active, even if OmniStay later raises its prices. Pausing the subscription does not end it. The founder rate ends, and cannot be recovered, if the subscription is cancelled, or if the client chooses another plan or another subscription term; OmniStay reminds the client of this before they confirm such a change. It applies to the per-listing price only: add-ons and plans keep their price.
4. Invoicing and payment
The subscription is payable in advance, every month, every year or every two years depending on the term chosen, by bank card or direct debit, through our payment provider Stripe, in the currency chosen. On the monthly term, a listing, an add-on or a plan added mid-month is invoiced pro rata on the next invoice, and a decrease is deducted in the same way. On the annual and 2-year terms, an increase (an additional listing, an add-on, a more complete plan, a higher AI assistant amount) is invoiced immediately, pro rata to the time remaining until renewal; a decrease (fewer listings, an add-on stopped, a smaller plan or a shorter term) takes effect at renewal, with no refund for the current period. The number of listings invoiced (the number chosen, or the connected listings if there are more of them) is adjusted every night according to these rules; a message warns the client before they connect a listing beyond the number chosen. Invoices are available in the client’s account.
With a launch offer or a referral link that includes it, the subscription starts with a free month, on the whole subscription, add-ons included, whatever the plan and the term: nothing is charged at sign-up, the client’s card is registered, and the first payment, the full price of the chosen plan and term, is made one month after sign-up, at the start of the first paid period. A client who cancels during that month is not charged. During that month, a change (listings, add-ons, plan or term) takes effect immediately, at no cost, and the first payment reflects it. The free month applies only once per account, to a client who has never had a subscription; only one offer applies at a time.
If a payment is declined, our payment provider presents it again in the following days. OmniStay notifies the client in their account and by email, on the same day and then on the third and seventh days; the client can pay at any time with another card, on the secure payment page.
In the event of late payment, penalties at the statutory interest rate plus ten percentage points are due, together with a fixed €40 indemnity for collection costs (article L. 441-10 of the French Commercial Code). After a reminder that remains unanswered for fifteen days, access to the service may be suspended; the data is kept.
5. Term and cancellation
On the monthly term, the subscription has no commitment: the client can cancel it at any time from their account, and cancellation takes effect at the end of the current month, already paid. On the annual and 2-year terms, the subscription is paid in advance for the term chosen and renews for the same term, at the price then in force; the client can cancel it, or choose a shorter term, at any time, effective at the end of the paid period, with no refund for the current period. The client can export their data at any time. After cancellation, the data remains available for export for 30 days, then is deleted, except for the invoices OmniStay is required to keep.
The client can also request the erasure of all their data at any time, from their account (Settings › Danger zone › “Erase all my data”): the subscription ends immediately, without waiting for the end of the paid period, which is not refunded, and access to the service is cut off. The data is permanently erased 30 days after the request. During these 30 days, the client can cancel the erasure from their account: their data and access come back, but the stopped subscription does not resume on its own. Only the invoices OmniStay must keep for 10 years remain (article L123-22 of the French Commercial Code). The privacy policy details what is erased and what is kept.
When cancelling, OmniStay may offer the client a discount on their next payments (for example 50% off the subscription for their listings for three months, or one month free) or a pause. Each discount applies only once per account. The client remains free to decline these offers and cancel; a client who rents out their own properties (“Host” profile) can cancel directly, without going through them.
The pause, offered when the monthly subscription exceeds €14.90, lasts 1, 2, 3 or 6 months, at most once in any 12-month period, and starts on the next payment date. During the pause, the client pays €14.90 per month, listings and add-ons included; their data, settings and the access of their team and owners are kept, but synchronisation with booking platforms is stopped and add-ons are suspended. The subscription resumes at the end of the pause, on the previous terms, or earlier at the client’s request: the unused pause time is then deducted from the next payment, pro rata.
6. Platforms and third-party services
Synchronisation with Airbnb, Booking.com, Expedia, Vrbo and the other platforms goes through their official interfaces and through connectivity providers. The client complies with these platforms’ terms. OmniStay is not responsible for decisions, changes or interruptions specific to these platforms, but informs the client as soon as an incident affects them and does what is necessary to restore synchronisation.
7. The add-ons
The AI assistant prepares suggestions (messages, review replies, actions): the messages it sends on its own are sent within the limits set by the client, and the client remains responsible for what is sent in their name. The add-on includes reasonable use; beyond that, the assistant may be limited until the following month, with the walkthroughs remaining available.
The showcase website is written and designed by AI from the client’s information; the client reviews it before publication and remains responsible for its content. It serves to present the client’s business. For a host (“Host” profile) who also has the Payments add-on, it additionally offers their properties for booking: the guest pays into the client’s Stripe account, and the stay is confirmed on payment. The reviews and figures it displays come from the client’s account; the client guarantees that they have the consent of the people whose testimonials they publish. Writing by AI includes reasonable use; beyond that, it resumes the following month, and the client can always edit their texts themselves. The website stays online for as long as the add-on is active.
With the Payments add-on, the client takes payments from their guests (deposits, extras, direct-booking stays) into their own Stripe account, which they connect to OmniStay with a key they create at Stripe. The money never passes through OmniStay, which takes no commission; Stripe’s fees are borne by the client, under their contract with Stripe. OmniStay keeps this key encrypted, only uses it for the operations requested in the app (payment pages, card holds, charges, refunds, reading the balance and payouts) and deletes it as soon as the client disconnects their account; the client can also delete it at any time at Stripe. The client remains solely responsible for the amounts collected, refunds and disputes, as well as for their right to collect payments on behalf of their owners (French professional licence “carte G”, Hoguet Act).
With the WhatsApp and SMS add-on, OmniStay sends the client’s guests, through its provider Zernio, the messages the client has scheduled or written, and files their replies in the app. The phone number ordered by OmniStay for the client is assigned to them for as long as the add-on is active; activating it requires an identity check of the client’s business, required by the regulations of the number’s country. The WhatsApp Business account is the client’s, who accepts its terms with Meta; Meta invoices them directly for messages sent more than 24 hours after the guest’s last message. The client only writes to guests who have given them their number for their stay, and for their stay only; a guest who replies STOP no longer receives SMS messages. When the add-on is stopped, the number is returned and can no longer be recovered; the conversations remain in the account.
SMS messages are prepaid. The client buys SMS credit in packs of €10, €25 or €50, charged at purchase to their subscription’s payment method; each pack is invoiced. The price of each SMS, depending on the recipient’s country and the length of the message, is deducted from the credit before sending: without sufficient credit, the SMS is not sent and the message goes out through the other available channels (WhatsApp, platform messaging or email). The price of an SMS the operator was unable to send is returned to the credit. The client can choose automatic top-up: with their consent, given in the app, the chosen pack is charged each time the credit falls below the chosen threshold; they can turn it off at any time. If a charge is declined, SMS sending is suspended until the next successful purchase. The credit has no expiry date while the account is open; it is neither refundable nor convertible into cash, unless otherwise required by law.
With the Social media add-on, in beta, OmniStay prepares every week, from the information in the client’s account (properties, photos, reviews, free dates and figures), posts for Instagram and TikTok: images, animated videos, video scripts and texts. OmniStay publishes nothing itself: the client reviews these posts, downloads them and publishes them from their own accounts, whose terms they accept with Instagram and TikTok. They remain responsible for what they publish and guarantee that they have the right to use the photos, reviews and testimonials featured. When the add-on is stopped, nothing new is prepared; posts already prepared remain in the account, to read and download.
8. Electronic invoicing
OmniStay calculates owners’ commissions and statements, but does not issue invoices in the client’s name. At the client’s request, it transmits them to the approved electronic invoicing platform of their choice (for example Tiime), which issues and transmits the official invoices.
9. Data
The client remains the owner of their data. For the data of their guests, team and owners, OmniStay acts as a processor within the meaning of article 28 of the GDPR: it only processes it to provide the service, according to the client’s instructions, and never sells it. OmniStay’s sub-processors and the safeguards applied are listed in the privacy policy, which serves as the data processing agreement.
10. Availability and security
OmniStay takes reasonable measures to keep the service available and secure: encrypted connections, least-privilege access rights, daily backups. Maintenance is carried out off-peak as far as possible.
11. Liability
OmniStay’s liability, for all causes combined, is limited to the amounts paid by the client during the twelve months preceding the event giving rise to it. OmniStay is not liable for indirect damage, such as loss of revenue or customers.
12. Referral and affiliate programme
Any client can recommend OmniStay (hereinafter, for this programme, “the affiliate”). Their referral link, which carries their personal code, is on the “Referrals” screen of their account, available to the person who manages the account.
A business becomes the affiliate’s referred client when it creates its account from this link. The link is made no later than 30 days after its account is created, and only if it does not yet have an active subscription. A business has only one referrer, and this link is final. A client cannot use their own link, and two clients cannot refer each other. The referred client gets their first month free, on their whole subscription, add-ons included, whatever their plan and their term: nothing is charged when they sign up, and their first payment is made one month later (article 4).
For each referred client, the affiliate earns a commission on the subscription for their listings (the price per listing for their term, no VAT, article 3), as actually paid by them: every month on the monthly term, and on each annual or two-year invoice on the annual or 2-year term. The rate depends on the referred client’s rank among the affiliate’s paying referred clients, in the order of their first payment:
- 30%: from the 1st to the 10th paying referred client;
- 40%: from the 11th to the 20th;
- 50%: from the 21st onwards.
The commission is calculated only on the “listings” part of each invoice for the referred client’s subscription, whether it is a monthly, annual or two-year invoice: after discounts, including pro rata when a listing is added or removed mid-period and, if part of the invoice was settled by a credit note, pro rata to what was paid. The following are not included in the commission: add-ons (article 7), even those included in a plan (article 3), SMS messages and any other recharged usage, the free first month, an invoice that is not the subscription invoice and an invoice left unpaid. If a payment is refunded or disputed, in whole or in part, the commission is reduced in the same proportion, or cancelled; if it has already been paid, the difference is deducted from subsequent commissions. A dispute decided in OmniStay’s favour reinstates the commission. The commission is due on each paid invoice, for as long as the referred client remains subscribed, with no time limit.
Each commission can be paid 30 days after the payment that gave rise to it. OmniStay pays it by bank transfer, in principle between 30 and 60 days after that payment, and emails the affiliate to arrange the transfer. The affiliate follows their commissions on the “Referrals” screen: pending, to be paid and already paid, and what has been removed for a refunded or disputed payment.
Deleting an account does not cancel commissions that have already arisen. If a referred client deletes theirs, the commissions arising from their payments remain due, and they still count towards the rank of subsequent referred clients. If the affiliate deletes theirs, their commissions that have already arisen remain due and are paid to them under the rules above; subsequent payments from their referred clients no longer give rise to commissions.
The affiliate recommends OmniStay fairly. In particular, they must not refer themselves (for example by creating another account with their own link), create fake accounts or fictitious sign-ups, advertise OmniStay, its prices or the referral programme misleadingly, use OmniStay’s name, brand or logo in a way that suggests they are OmniStay or speak on its behalf, or send unsolicited messages. In the event of a breach, OmniStay may cancel the commissions concerned and end their participation in the programme.
The affiliate acts in their own name and fully independently: they are neither an employee, nor an authorised representative, nor a commercial agent of OmniStay, and cannot bind it. Commissions are income: they declare them themselves and pay the related taxes and contributions, according to their situation.
OmniStay may change the referral rules or end the programme by notifying affiliates at least one month in advance. Commissions arising from payments received up to the effective date remain due and are paid under the rules above.
For the referral programme, OmniStay processes the affiliate’s code, the accounts created with their link, their sign-up and first payment dates, and the commissions (amounts, dates and payments). The affiliate sees the number of their referred clients and their commissions, never the names of the referred businesses. This data is processed in accordance with the privacy policy.
13. Governing law
These terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution; failing that, the courts with jurisdiction over OmniStay’s registered office have sole jurisdiction.
